These are the terms you agree to by using Gladden. They are written to be read. Where a term protects us, it says so plainly rather than hiding inside a paragraph about something else.
1. Who we are
Gladden is operated by Tinman DMC ("we", "us"). You can reach us at [email protected].
2. Using Gladden
You need an account, and you must be 13 or older to have one. If you are under the age of digital consent where you live — 16 in much of Europe — you need a parent or guardian's permission.
One person, one account. Keep your password to yourself; anything done with your password is treated as done by you.
You agree not to use Gladden to break the law, to attack or overload our systems, to get at anybody else's entries, or to automate account creation. We can suspend or close an account that does any of those, and for repeated or serious abuse we may do so without warning.
3. What you write stays yours
You own your entries and your photos. Nothing you write in Gladden becomes ours, and we do not claim any right to publish, sell, license or train on it.
You give us one narrow permission, and only what the app cannot work without: to store your entries and photos, move them between your devices, and show them back to you. That permission exists to run the service and ends when you delete the content or your account.
What you write must be yours to write. Don't upload photos you have no right to, and be thoughtful about naming other people — a gratitude journal about somebody is still a record about them.
4. What we don't promise
Gladden is provided as is. We work hard on it, but we do not promise it will be uninterrupted, error-free, or that a notification will always arrive on time. Notifications in particular depend on Apple, Google and your own phone's settings, none of which we control.
Gladden is not a medical or mental-health service. Gratitude journalling is well-studied and often helpful, but it is not treatment, and nothing in the app is advice about your health. If you are struggling, please talk to a doctor or a crisis line.
5. Your data, and getting it out
How we handle personal data is set out in our Privacy Policy, which is part of these terms.
Two things worth repeating here:
- You can export everything, any time, from Settings.
- You can delete your account, any time, from Settings. That removes your entries, your photos and the account itself. We do not keep a copy, and it cannot be undone.
Your entries are not end-to-end encrypted. They are encrypted in transit and on disk, but whoever operates the database can technically read them. We say so here because you should decide what to write knowing it.
6. Paying, if that ever applies
Gladden is free today. If we introduce a paid tier we will say so clearly before anything is charged, and anything you have already written stays available to you. We won't put your own past entries behind a payment.
7. Ending things
You can stop using Gladden whenever you like, and delete your account from Settings.
We may suspend or end an account that breaches section 2, or discontinue Gladden entirely. If we shut the service down we will give at least 30 days' notice by email and leave export working for that whole period, so nobody loses their writing because we changed our plans.
8. Liability
Nothing here limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud.
Beyond that, and to the extent the law allows: we are not liable for indirect or consequential loss, for lost profits, or for lost or corrupted data beyond what we can restore. Because Gladden is free, our total liability is limited to £100 — or, if you have paid us in the last twelve months, the greater of £100 and what you paid.
Your entries are stored on your device as well as our servers, and you can export them at any time. We strongly encourage you to keep your own copy of anything you would be upset to lose.
9. Changes to these terms
We may update these terms. If a change materially affects your rights we will tell you in the app or by email before it takes effect, and the date at the top will change. Continuing to use Gladden after that means you accept the new terms; if you don't, you can export your entries and delete your account.
10. Law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country you live in.
If any part of these terms is found unenforceable, the rest still applies.
